The Psychoactive Substances Act 2013 (the Act) was enacted on 18 July 2013. Under section 67 of the Act territorial authorities are authorised to develop a local approved products policy which may impose restrictions on the location of premises within the district from which a licensed person may sell approved products.
1 POLICY PURPOSE
The purpose of the policy is to provide guidance to the ‘Authority’ (Ministry of Health) on the preferred location of premises who are licenses to sell ‘Approved Products’ (psychoactive substances) within the New Plymouth and Stratford Districts.
2 POLICY OBJECTIVES
- To regulate the availability of psychoactive substances in the New Plymouth and Stratford districts to protect the health of, and minimise harm to, individuals who use psychoactive substances.
- To minimise the potential harm to sensitive communities within the New Plymouth and Stratford districts caused by psychoactive substances by limiting the location of the retailers of approved psychoactive products.
3 POLICY STATEMENTS
a) Premises licensed for the sale of approved products pursuant to the Psychoactive Substances Act 2013 must be located within the New Plymouth Central Business District area shown as the Business A Environment Area as defined and shown within the New Plymouth District Plan (map A).
b) Any new licence for the sale of approved products pursuant to the Psychoactive Substances Act 2013 is not permitted for a premises within 100m of any existing premises holding a licence to sell approved products.
c) Premises licensed for the sale of approved products pursuant to the Psychoactive Substances Act 2013 are not permitted within 50m of any places of worship, early childhood, educational or recreational facility (including gyms) or open space used by, or likely to attract young people under the legal purchase age; community and/or health facility, bus stops and taxi stands.
The policy holder is the Corporate Policy and Strategy Team within the Executive Services Group.
This policy shall be reviewed five yearly from the date the policy is adopted.
