Draft Bylaws 2008

Bylaws help ensure New Plymouth District is vibrant, healthy and safe. Their purposes include:

  • Requiring activities to be licensed; to ensure activities are carried out in a safe and responsible manner.
  • Informing the community about acceptable standards of behaviour in public places.
  • Promoting a nuisance-free environment, i.e. through rules on the keeping of animals.
  • Ensuring that the public can safely use public land.

Bylaw review

Under the Local Government Act 2002, all bylaws need to be regularly reviewed. An internal review of the 2000 Consolidated Bylaw occurred from October 2006 to February 2008.

The 2000 Consolidated Bylaw has 21 parts. The apartment buildings and boarding houses part of the bylaw is now covered the Building Act 2004 and this part of the bylaw will be automatically revoked on 1 July 2008.

The following parts of the 2000 Consolidated Bylaw have not been reviewed as they were made in the last five years and will remain as part of the 2008 Bylaw.  These are:

  • Dog control (reviewed in 2005).
  • Liquor control (reviewed in 2006)
  • Brothels and commercial sex premises (created after 1 July 2003).
  • Speed limits (created after 1 July 2003).
  • Food safety (this bylaw is made under the Health Act 1956. It may be reviewed pending the outcome of a government review of food legislation).

The remaining 15 parts of the 2000 Consolidated Bylaw have been reviewed and will be replaced by parts 1 - 15 of the New Plymouth District Bylaws 2008.

The council is asking for public feedback on the draft Bylaws 2008. Submissions have closed for all but Part 11 (Trade Waste). Submissions for Part 11 - Trade Waste close at 5pm on Tuesday 3 June.

Feedback closes: Friday 2 May 2008 (submissions for Part 11 - Trade Waste close one month later at 5pm on Tuesday 3 June).

What's next?

The council is scheduled to meet on Monday 9 June 2008 to consider all submissions. They will then meet on Thursday 26 June 2008 to adopt the bylaws and any amendments.
