Part 21 Speed Limits

1.0 Interpretation
BYLAW SPEED LIMIT means a speed limit for vehicle traffic validated or fixed by or under this bylaw.

COUNCIL means the New Plymouth District Council.

ROAD has the same meaning as in the Land Transport Rule: Setting of Speed Limits 2003, but does not include any State Highways within the district.

ROAD CONTROLLING AUTHORITY has the same meaning as in the Land Transport Rule: Setting of Speed Limits 2003.

RURAL AREA has the same meaning as in the Land Transport Rule: Setting of Speed Limits 2003.

SPEED LIMIT has the same meaning as in the Land Transport Rule: Setting of Speed Limits 2003.

URBAN TRAFFIC AREA has the same meaning as in the Land Transport Rule: Setting of Speed Limits 2003.

VEHICLE has the same meaning as in section 2(1) of the Land Transport Act 1998.

2.0 Application of this Bylaw
This bylaw applies to all roads for which the New Plymouth District Council is the road controlling authority, and includes all roads under the ownership or control of the council.

3.0 Bylaw Speed Limits
3.1 In accordance with section 10 of the Land Transport Rule: Setting of Speed Limits 2003:
a) The roads saved under section 4 of the Transport Amendment Act 1997 and identified on the attached schedules and plans (numbered LTO 332/1A, LTO 332/2A, LT 9732/3, LT 9732/4, LT 9732/5, LT
9732/6, LT 9732/7 and LT 9732/8, which form part of this bylaw) as having a 50km/hour speed limit are hereby designated as urban traffic areas;

Urban traffic areas – 50 km/h
b) Any speed limit saved under section 4 of the Transport Amendment Act 1997 and identified on the attached schedules and plans (numbered LTO 332/1A, LTO 332/2A, LT 9732/3, LT 9732/4, LT 9732/5, LT 9732/6, LT 9732/7 and LT 9732/8, which form part of this bylaw) other than those referred to in section 10.1(2)(a) and (b) of the Land Transport Rule: Setting of Speed Limits 2003), is hereby validated.

Other speed limits
(Copies of the plans are also available for inspection at New Plymouth District Council, Civic Centre, Liardet Street, New Plymouth.)

3.2 The council may, by resolution in accordance with clause 4 of this bylaw, make additions or alterations to the bylaw speed limits for any roads or areas identified on the attached schedules and plans. The council may set speed limits of 20, 30, 40, 50, 60, 70, 80, or 100 km/h on any road or area in the district.

3.3 The council may, by resolution in accordance with clause 4.1 of this bylaw and in accordance with the Land Transport Rule: Setting of Speed Limits 2003, make or alter bylaw speed limits for roads in any of the following
designated locations:

Speed limits in other locations
a) a car park;
b) an educational or scientific facility;
c) a health facility;
d) a residential facility;
e) a camping ground;
f) a sports facility or other recreation area;
g) a botanical garden;
h) a port or wharf area;
i) an airport;
j) a beach;
k) a cemetery;
l) a facility operated by the New Zealand Defence Force;
m) any other location approved by the Director of Land Transport Safety.

4.0 Consultation
If the council chooses to create, amend or alter any bylaw speed limit by way of resolution under clauses 3.2 or 3.3 of this bylaw, the consultation process in clause 7.1 of the Land Transport Rule: Setting of Speed Limits 2003 must be followed.

5.0 Offences
Every person commits an offence against this bylaw who operates a vehicle in excess of the bylaw speed limits set by this bylaw. Offences, penalties and fees relating to infringement of speed limits are provided for in the relevant provisions of the Land Transport Act 1998 and the Transport Act 1962. These do not change as a result of this bylaw.

6.0 Schedules
Schedule 1: Roads that have a speed limit of 20 km/h. (Schedule 1 is intentionally blank for future use).
Schedule 2: Roads that have a speed limit of 30 km/h. (Schedule 2 is intentionally blank for future use).
Schedule 3: Roads that have a speed limit of 40 km/h. (Schedule 3 is intentionally blank for future use).
Schedule 4: Urban traffic areas - roads that have a speed limit of 50 km/h.
Schedule 5: Roads that have a speed limit of 60 km/h. (Schedule 5 is intentionally blank for future use).
Schedule 6: Roads that have a speed limit of 70 km/h.
Schedule 7: Roads that have a speed limit of 80 km/h (Schedule 7 is intentionally blank for future use).
Schedule 8: Rural areas – roads that have a speed limit of 100 km/h.
Schedule 9: Roads that have a holiday speed limit. (Schedule 9 is intentionally blank for future use).
Schedule 10: Roads that have a variable speed limit. (Schedule 10 is intentionally blank for future use).
Schedule 11: Roads that have a minimum speed limit. (Schedule 11 is intentionally blank for future use).

SCHEDULE 1 - Roads that have a speed limit of 20 km/h
The roads or areas described in this schedule or as shown on a plan referenced in this schedule are declared to have a speed limit of 20 km/h.

SCHEDULE 2 - Roads that have a speed limit of 30 km/h
The roads or areas described in this schedule or as shown on a plan referenced in this schedule are
declared to have a speed limit of 30 km/h.

SCHEDULE 3 - Roads that have a speed limit of 40 km/h
The roads or areas described in this schedule or as shown on a plan referenced in this schedule are
declared to have a speed limit of 40 km/h.

SCHEDULE 4 - Urban traffic areas - roads that have a speed limit of 50 km/h
The roads or areas described in this schedule or as shown on a plan referenced in this schedule are
declared to be urban traffic areas that have a speed limit of 50 km/h.

Rural areas - roads that have a speed limit of 100 km/h
The roads or areas described in this schedule or as shown on a plan referenced in this schedule are
declared to be rural areas that have a speed limit of 100 km/h.

All New Plymouth District roads outside the urban traffic area linked in Schedule 4, have a speed limit of
100 km/h except for roads or areas:
a) Described as having a different speed limit in the appropriate schedule or bylaw; or
b) Shown on a plan as having a different speed limit, as referenced in the appropriate schedule of this
bylaw.

SCHEDULE 9
Roads that have a holiday speed limit
The roads or areas described in this schedule or as shown on a plan referenced in this schedule are declared to have a holiday speed limit as set out in the schedule and/or plan.

SCHEDULE 10
Roads that have a variable speed limit
